TERMS & CONDITIONS
1. Tour Confirmation and Payment
Upon booking, you will be required to pay in full to secure your place on the tour.
2. Cancellation Policy
If you cancel your booking more than (three days) 72 hours prior to the tour date, you will
receive a full refund, minus any card fees.
If you cancel your booking 71hours or less prior to the date of the tour, you will not be
entitled to a refund.
In the event of unforeseen circumstances, Magnascape Corporation Pty Ltd reserves the
right to cancel the tour. If this happens, Magnascape Corporation Pty Ltd will refund the
client in full (less 3.6% in the case of online credit card transactions) within 30 days.
If this product is bought as a Voucher or Gift Voucher then a 0% refund policy applies.
3. Refund Policy
The provision services by Magnascape Corporation Pty Ltd is subject to availability. In cases
of unavailability, Magnascape Corporation Pty Ltd will refund the client in full within 30 days,
less any credit card fees incurred.
4. Tour Itinerary and amendments
The tour itinerary may be subject to change due to unforeseen circumstances.
The tour operator will make reasonable efforts to ensure that the tour runs as planned, but
cannot be held responsible for any changes or delays.
Management reserves the right to amend/cancel/add terms & conditions without notice.
If Magnascape Corporation Pty Ltd does not have access to the wine farms of the booked
service or voucher on the day of the tour then Magnascape Corporation Pty ltd has the right
to move the tour to other wine farms
4. Group Size
The tour requires a minimum of 4 people to run.
The maximum group size for the tour is 10 people.
5. Child Policy:
Unfortunately we cannot allow anyone under 18 to take part in this tour.
6. Wine Tastings
Wine tastings will be included at each of the three wine farms visited.
The specific wines offered for tasting will vary depending on the individual wine farms.
7. Lunch, Food and Beverages
The tour includes water, and a coffee and pastry at Motherdough.
Additional food and beverages may be available for purchase at the wine farms.

All wine purchases are for your own account
8. Transportation
Transportation to and from the wine farms will be provided.
The tour operator reserves the right to use a variety of transportation options, depending on
the group size and the specific wine farms being visited.
9. Liability
The tour operator is not responsible for any personal injuries or property damage that may
occur during the tour.
Participants are responsible for their own safety and well-being.
10.INDEMNITY
All participants are required to sign an indemnity form for all activities they are participating
in prior to departure of the activity. If a guest refuses to sign the indemnity form, the guest
will not be able to partake in the activity.
11. Insurance
It is recommended that participants have their own travel insurance to cover any unforeseen
circumstances.
12. Governing Law
These Terms and Conditions are governed by the laws of South Africa.
Any disputes arising out of or in connection with these Terms and Conditions shall be
submitted to the exclusive jurisdiction of the courts of South Africa
I hereby indemnify Magnascape Corporation Pty Ltd, Magnas Tours, its affiliated companies,
associates, shareholders, directors, employees and all other related parties against any
claims occasioned as a result of my participation in any activity provided by Magnas Tours,
irrespective whether said injury, loss or damage is caused by accident, negligence or gross
misconduct by any individual related to Magnascape Pty Ltd or any other party.
I confirm that I understand the meaning and importance of such a disclaimer, the waiver of
claims and indemnity and, that by agreeing hereto, I am waiving substantial legal rights (on
my behalf and on behalf of my dependants). I acknowledge that I have been free to secure
independent legal and/or other advice as to the nature and effect of all provisions of this
liability disclaimer waiver and indemnity and that I have either taken such independent legal
action and/or other advice or dispensed with the necessity of doing so.
I acknowledge that I have read and understood the above liability disclaimer and waiver of
claims.
CONFIRMATION ACCEPTANCE
PAYMENT OPTIONS ACCEPTED
Online Payment may be made via Visa and MasterCard.
Payment can also be made via Electronic Transfer.
CARD ACQUIRING AND SECURITY
Card transactions will be acquired for (Magnascape Corporation Pty Ltd) via PayGate Pty
Ltd who are the approved payment gateway for all South African
Acquiring Banks. PayGate Pty Ltd uses the strictest form of encryption, namely Secure
Socket Layer 3 (SSL3) and no Card details are stored on the
website. Users may go to www.paygate.co.za to view their security certificate and security
policy.
CUSTOMER DETAILS SEPARATE FROM CARD DETAILS
Customer details will be stored by (Your Company) separately from card details which are
entered by the client on PayGate’s Pty Ltd secure site. For more detail on PayGate Pty Ltd
refer to www.paygate.co.za
MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is
South Africa. Transaction currency is
South African Rand (ZAR).
COUNTRY OF DOMICILE
This website is governed by the laws of South Africa and Magnascape Corporation Pty Ltd.
Cape Town chooses as its domicilium citandi et executandi for all purposes under this
agreement, whether in respect of court process, notice, or other documents or
communication of whatsoever nature.
VARIATION
Magnascape Corporation Pty Ltd may, in its sole discretion, change this agreement or any
part thereof at any time without notice.
